Breefly - Terms of Service

Welcome to Breefly! These Terms of Service ("Terms") govern your use of the Breefly mobile application (the "App") and the breefly.xyz website, provided by Breefly ("us", "we", or "our").
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the App.
1. Use of the App
1.1. Breefly is intended for personal, non-commercial use only. You may not use the App for any illegal or unauthorized purpose, nor may you, in the use of the App, violate any laws in your jurisdiction (including but not limited to copyright laws).
1.2. You must be at least 13 years old to use the App.
1.3. You agree not to interfere with or disrupt the App or our servers, circumvent its access controls or rate limits, scrape or bulk-download its content, or transmit any malware or code of a destructive nature.
1.4. Breefly has no accounts. Your saves, history, and preferences are kept under an anonymous identifier as described in our Privacy Policy, and you can delete them at any time from the App's Settings.
2. Breefly+ Subscriptions
2.1. Some features require a paid Breefly+ subscription, offered as monthly and yearly auto-renewing plans at the prices shown in the App. Payment is charged to your Apple ID account through the App Store at confirmation of purchase.
2.2. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings (or from Manage Subscription in the App's Settings) at any time; cancellation takes effect at the end of the period already paid for.
2.3. New users receive a free 30-day preview of Breefly+ features, measured from first use of the App. It requires no payment information, does not convert into a paid subscription, and simply ends unless you subscribe. It is provided once per user and is not reset by reinstalling the App.
2.4. All purchases, billing, and refunds are handled by Apple under its terms; we never receive your payment details. Refund requests are made through Apple.
3. News Content and AI
3.1. The App presents headlines, excerpts, images, and links from news publishers. That content belongs to its publishers, is presented for your personal reference, and its accuracy is theirs, not ours.
3.2. Summaries, story groupings, Breefs, question answers, audio narration, and source bias ratings in the App are generated with artificial intelligence. AI-generated content can be incomplete or wrong. It may misstate details of the underlying reporting, and bias ratings are informational editorial assessments, not statements of fact. Always check the original article before relying on anything you read or hear in the App, and do not treat the App's content as professional, financial, legal, medical, or investment advice.
3.3. If you are a rights holder and believe content in the App infringes your copyright, contact us at info@breefly.xyz with the material identified and where it appears, and we will respond promptly.
4. Intellectual Property
4.1. The App and its original content, features, and functionality are and will remain the exclusive property of Breefly and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Breefly.
5. Termination
5.1. We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
5.2. You may stop using the App at any time, and you can remove the data stored under your identifier with Delete My Data in the App's Settings.
6. Disclaimer of Warranties
6.1. The App is provided "as is" and "as available", without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that its content — including AI-generated content — will be accurate or complete.
7. Limitation of Liability
7.1. To the maximum extent permitted by law, Breefly and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the App, including any reliance on its content. Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us in the twelve months before the claim arose, or fifty dollars ($50), whichever is greater.
8. Indemnification
8.1. You agree to indemnify and hold harmless Breefly from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the App.
9. Governing Law
9.1. These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
10. Changes
10.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
10.2. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
